Just a speculative thought about taxes and The Hobby

A week or so ago, SCOUTS handed down a decision that allows sales taxes to be collected for on-line transactions regardless of the state or if either party has a brick-and-mortar establishment.

Some crafty and creative prosecutor could try to apply this to Participants in The Hobby the way they applied income tax laws against Al Capon.

The charge would not be prostitution or pandering . . .the charges would have something to do with not collecting and remittent to the state sales tax for services rendered. This might be made to work even if a strong defense could be made for "consulting" services or companionship.

I know this is a bit out there, but these are crazy times.
Indulge us as to how a crafty prosecutor would pursue this. I'm not following you.

Rather than making a legal case for prostitution, it might be possible to make a case for tax evasion . it would not be necessary to prove a case based on money-for-sex. It would only be necessary to show that services of any kind was provided for money; such as "companionship", which is a time-worn euphemism. Even "consulting" or "counselling" would be services subject to sales tax collection and remittance.

The law that was reviewed by the SCOTUS only applied to businesses doling more than $100,000 of business in a state, but some providers will come in at that level or higher I am sure. As more states work through this new decision THAT LEVEL WILL COME DOWN.

some prosecutor somewhere will give it a go.

there already was/is a sales tax in texas for personal services such as this

Personal Services
Services such as laundering, dry cleaning, carpet cleaning, massage services performed by massage parlors, Turkish baths and escort services are taxable personal services.
The term “massage services” does not include massages provided by licensed massage therapists.
Manicures, pedicures, tanning, piercing, tattooing and similar services are not taxable.

the issue has always been in the past the man power needed versus the tax collection benefit

likewise there has "always" been a use tax, which is assessed against a purchaser where the seller did not have a physical location in texas. the use tax is due on all otherwise taxable purchases where sales tax was not assessed and collected by the seller.

again, the problem was in going after an individual who, say, might have made $300 in on-line purchases yielding a tax due of $24.75 for the year

going after 10 million individuals for $25 dollars each is much more difficult than going after amazon, or better yet having amazon collect all that for you

with this new supreme court decision its much easier and much more lucrative to go after the seller for sales inside a state
