Christian college takes a stand against Biden’s gender identity mandates

An administration run by decadent coastal elites is forcing schools to violate the core tenets of their deeply held religious beliefs.
© Provided by Washington Examiner Back in January, President Joe Biden signed an executive order titled “Preventing and Combating Discrimination on the Basis of Gender Identity or Sexual Orientation.” The order explicitly noted that the phrase “sex discrimination” would be interpreted broadly in all areas where the federal government has jurisdiction and would include “discrimination on the basis of gender identity or sexual orientation.” The executive order also directed federal agencies to alter their activities in order to “implement statutes that prohibit sex discrimination” more fully.

The next month, the Department of Housing and Urban Development issued a directive requiring the Fair Housing Act to be enforced in a way that prohibits discrimination in housing based on sexual orientation and gender identity. But the directive squarely clashes with the deeply held beliefs of religious schools, including Christian schools that provide student housing in dormitories. These schools don’t believe that men and women can simply self-identify as belonging to a sex other than their biological sex. Worse, the directive infringes on these schools’ religious beliefs and silences their attempts to express their sincerely held values.
Our First Amendment guarantees the dual freedoms of speech and religion because they are integral to the American experience. Unfortunately, due to the growth of the federal government, these freedoms are especially vulnerable to the excesses of the administrative state, which the Biden administration is using, through the power of unelected bureaucrats, to impose left-wing ideology upon private religious colleges.
Enter College of the Ozarks, a private Christian college in Missouri. Call the school old-fashioned, but it separates its student residences, consistent with its religious beliefs, by biological sex. The idea that God created two sexes, and that individuals cannot merely switch back and forth among many genders, is a core tenet of the college’s Christian faith, and it proclaims these beliefs in its student handbook, website, and other materials. Nevertheless, the college is a housing provider that falls under the purview of the HUD directive.
HUD wants the school to use gender identity, not biological sex, to assign students to dormitories. And it wants the school to acknowledge and publicize such a policy through statements made by school officials and in school materials. Failing to comply is costly. The college faces a potentially insurmountable wave of investigations, enforcement actions, and lengthy, expensive litigation.
But complying with the directive is even costlier, from a spiritual perspective. The Biden administration is trying to coerce the college into violating the very religious values upon which it was founded, ordering it to ignore its belief in sex as an immutable characteristic determined by God. This is a clear violation of the First Amendment, restricting both the school’s ability to maintain sex-separated dorms freely and its right to express its religiously based conception of the human person.
But justice was recently denied — for now. The District Court for the Western District of Missouri dismissed the case, claiming that the school isn’t yet in danger of “sustaining … a concrete and particularized harm that is actual or imminent.” That essentially means that College of the Ozarks needs to take its chances for now, just waiting until the Biden administration comes after it.
Yet the spirit of liberty is not extinguished so easily. The college has appealed the decision. The school’s president, Jerry Davis, understands the fight ahead of him. He stated: “We will not let a radical executive order or agency directive strip us of our core religious values and force us to allow members of the opposite sex to infiltrate our women’s dorms and showers.”
The school is represented by the Alliance Defending Freedom. A host of other organizations and entities filed friend of the court briefs in the 8th Circuit Court of Appeals, including the organization in which I serve as a communications fellow, Mountain States Legal Foundation. MSLF is dedicated to securing constitutional rights for all, as expressed in its motto: "Free country, free people."
All College of the Ozarks wants is its day in court. It wants to be able to fight for the precepts that have guided its growth for over a century, the very precepts that are protected explicitly in the First Amendment. Our justice system was designed for this, occasions when the federal government attempts to bully its constituents into submission. And justice must prevail.
