Can a legit provider do this?

Texted HeaselSkie (https://eccie.net/providers.php?do=view&id=529273) a while back because I was interested in seeing her. There is one written Encounter with her that even recommends her. I was gonna set up an incall and asked what the donation prices were because on her Tryst page, it only says "Companionship: $200" without specifying the rates per time period. Her reply was:

"I don't message Donations
we can speak about that in our Session...
Hope to see you Soon"

Do providers have the option to do this? And if so, would this nonetheless be considered a red flag similar to how most of us feel about ones that ask for deposits?

While I most certainly would be hesitant due to the possible upsell implications, it could also be that she is attempting to set a shield against a sting operation by not agreeing to anything in communication that would run afoul of Texas's statutory language.
