Vietnam veteran loses gun rights over 45 year old misdemeanor

They are at it again. The gun grabbers. 45 years ago Jeffrey Schrader defended himself on the street from some Maryland thugs. Local police, never happy with sailors, arrested him and he paid a $109 fine. He then went to Vietnam for two tours and has lead a clean life since his heinous act. Now he finds that since Maryland upped the penalty of punching someone to a penalty of two years in prison he can no longer own or buy a weapon legally. So much for civil rights.

More prevailing is the difficulty anybody with a felony has in finding a job when they get out of jail. What is a girl meant to do, find a sugar daddy?

There should be time limits and avenues back into the normal world.

Whatever happened to forgiveness in a Christian country, for the contrite who have served their time?

Let's see. Did they grab EVERYBODY'S gun? Or just his according to the law of the state? If it's the latter, then I guess it's a fucked up law.

So what you're saying is THE Gun Grabbers were "after him" when they passed whatever law made him no longer eligible to own one.

Here you base your post on a "story" from an "aggregator" blog with less than a month's worth of content (it's been on facebook for 5 days now) which gets its entire info from Glenn Beck's the Blaze. Actually, I'm guessing you're one of the THIRTEEN who "liked" it on FB. Uh-oh!

Extremely well-reasoned opinion but an unfortunate outcome for the vet. Read the opinion....or at least the last 4 pages. His lawyers fucked up and didn't preserve the issue of whether the statutory provision they were challenging applied to the veteran individually....they only argued it shouldn't apply to the class of persons convicted of the type of crime that prevents the vet from owning a gun. The court makes quite clear that if the veterans lawyers had made the proper argument in the lower court, the vet would have won this appeal.

By the way, this isn't the gun-grabbers at it again.....it's been the law for 45 years....since the passage of the 1968 GCA.

I doubt you'll find enough gun grabbers in Georgia to make a difference.

They do have some pretty stubborn Whippersnappers down there, though.

I guess Whatzup still can't read. He was arrested and fined in Maryland. He lives in Georgia now. This is a local law that was loosely interpreted and has now come under the perview of the federal government. If he was such a bad person then how could he be sent to Vietnam or even stay in the navy? This is not federal law, this is not Georgia law, this IS Maryland law. So I guess the federal government is in some serious trouble for allowing him to buy guns, and carry a gun in Vietnam. They are an accessory to a serious crime apparently. I say ARREST Eric Holder immediately and charge him.

I wonder when the "assault" occurred. The GCA of 1968 was passed on October 22, 1968.
