NY Attorney General Wannabe Letitia James criminally charged

So TX’s defense is that James is stupid. As believable an excuse as any, I suppose.

Letitia James made a... mistake on a mortgage form...

I’m saying this with a totally straight face. Originally Posted by txdot-guy

Have any of yinz ever applied for a mortgage loan?

So you expect me to believe that the Attorney General for the State of New York, with degrees from Lehman College, Columbia University and Howard University Law School...

... didn't understand what the definition of "primary residence" is?

... and didn't know you can only own or live in ONE primary residence at any time?

If you believe that, I want to sell you the Brooklyn Bridge.

There's poetic justice here. As a prosecutor and head of the FBI, Comey investigated and convicted people for inconsequential lies, and now he's being prosecuted for the same. The charges against Letitia James are almost a mirror image of what she used to go after the Trump Organization. However, the DOJ should not prosecute either. It won't get convictions, and these are chicken shit charges, just like the ones against Trump tried in Manhattan court rooms.

Excerpts from Friday's WSJ:

Donald Trump and Letitia James, Lawfare Pals

The New York Attorney General sued him for fraud. Now the President’s Justice Department indicts her for fraud. This is madness.

...Ms. James accused Mr. Trump of civil fraud, while giving no evidence that his sophisticated lenders suffered any losses. Nevertheless, the trial judge imposed a financial penalty of roughly half a billion dollars. When that was invalidated in August, Ms. James promised to appeal to the state’s highest court “to protect the rights and interests of New Yorkers.”

This week’s indictment of Ms. James gives no indication that anyone lost money. Federal housing regulator Bill Pulte seems to believe his job is to dig through filing cabinets for dirt on Mr. Trump’s enemies, even as news reports suggest flyspecking mortgages to this degree could fill America’s jails in about five minutes, including with Republicans. To pick one, the outfit ProPublica claims Labor Secretary Lori Chavez-DeRemer “entered into two primary-residence mortgages in quick succession.”

Worried about Mr. Trump’s promises of retribution, President Biden issued blanket pardons on his way out the door. After taking his revenge, will Mr. Trump have to do the same on Jan. 20, 2029? This is madness.

The better path for the country is for both parties to conclude that the lawfare of recent years has been a historic mistake, and that nobody benefits from becoming a banana republic. Mutual assured legal destruction is no way to run a great nation.

that there's much more to this Letitia James indictment.
More that may include NY Gov. Hochul.

... We'll just have to wait and see...

Did anyone here actually read the indictment. It’s about as flimsy as it gets.

After winning her $355 million judgment against Trump on February 16, 2024, James declared:

“Everyday Americans cannot lie to a bank to get a mortgage to buy a home, and if they did, our government would throw the book at them. There cannot be different rules for different people. No one is above the law.”

The "mistake" she is accused of making on her other property - at 296 Lafayette Avenue in Brooklyn NY - is different. For the Brooklyn dwelling, she is accused of repeatedly understating the number of units.

"In mortgage after mortgage, year after year, the property is consistently misrepresented—sometimes as a “four-family” dwelling, other times as a “one or two family” residence. But never once as the five-unit building it legally is:

June 21, 2021: Citizens Bank – “Dwelling Only – 1 or 2 Family Residence”

August 23, 2019: Citibank – “Dwelling Only – 4 Family”

October 26, 2017: Wells Fargo – “Dwelling Only – 4 Family”

January 26, 2015: Municipal Credit Union – “Dwelling Only – 4 Family”

August 23, 2011: US Bank (HAMP) – “4 Fam.” (handwritten)

May 25, 2007: American General – “Property Improved by a 1–2 Family Residence”

October 26, 2006: American General – “Improved by 1–3 Family Dwelling”

July 1, 2005: MERS – “Dwelling Only – 4 Family”

August 29, 2003: MERS – “Premises Improved by 4 Family Dwelling”

March 30, 2001: Chase Manhattan – “Premises Improved by One or Two Family”

Pattern: 10+ false statements across 20 years to different federal lenders, each obtaining better residential loan terms through fraud."

Here's a blog that dives deep into the weeds of the case against her. It may be partisan but it's also very detailed. Looks like Tish's lawyer (Abbe Lowell) will have his hands full in defending her.

They're based on simple fraud, not on that obscure New York state consumer protection statute - Executive Law 63(12) - Tish dredged up as AG to convict trump because she knew she couldn't possibly meet the standards of proof required for simple, common-law fraud.

Here's a thought - let's throw out BOTH cases. After all, they're both "chicken-shit". Let's drop the charges against Tish James and nullify the verdict/judgment against trump. No quid pro quo, of course. Just a few quiet BCD handshakes between Bill Pulte, Abbe Lowell and Rowan Wilson. You know, the art of the deal. Sound fair?

I think the most important comment I would make is that most information I have found online is predicated on the assumption that she is guilty and that no one is considering how difficult it will be to prove that she knowingly lied on her mortgage forms. The case that the defense will make hasn’t been presented yet.

A quick search of the home at 296 Lafayette Avenue in Brooklyn NY is 3 stories and a basement which consists of 2631 sq feet and holds a NYC property classification of C3 Four Families. Maybe that’s why the paperwork shows that so often?

https://www.propertyshark.com/mason/...ing_class.html

The second property in question for her niece can be explained away by a mere mistake in the paperwork. Not even lawyers will read every document and will rely upon the mortgage broker to get the correct paperwork.

When these types of mistakes occur they are usually brought to the attention of the correct person and restitution is made.

Only in Trump’s justice department will this be prosecuted.

This case is full of holes and I have doubts that it will actually goto trial.
