Wow, this is a long thread. I am a professional published photographer. Here's my "opinion"

1. Whoever takes a photo owns the copyright. If you ask your friend to take a photo of you using your own phone, your friend owns the copyright to that photo. On the other side, the model owns the "likeness".

2. The copyright holder has control to what happens to the photo. However, there are limitations. For example, an ad company wants to use the photo. This would be a money making venture, the copyright does not extend. The copyright holder needs to get permission from the model to use the "likeness". . Same thing if that photo is to be published in a magazine.

3. "Model Release (contract)" - This is probably the most misunderstood document in modeling/photography industry. When a model signs a model release, the model is "releasing" rights to the likeness to the photographer. Most of the time, all rights are being released or given to the photographer. The photographer/copyright holder can now do anything with the photo. This includes anything for profit.

4. How would models protect themselves? First, do not sign a release, this is especially if you are paying for the session. If you are paying for photographer's services, ask the photographers to relinquish copyright to you. Now, the model has control. If the photographer, for some reason, wants to use your photo, that photographer will need a "license" to use your likeness.

5. "License to use likeness" - This is where the big bucks come in for the models. You can give full license, restricted license, license with limited time or expirations date ...etc. The models in the campaign ads in magazines are paid the big bucks not because they showed for a shoot but for the use of their likeness.

6. Summary, a photog can do whatever he wants with a photo as long as he is not making off them. He can put his watermark, post the photos on FB or forums, even use for educational purposes. Models has to give a license to use the likeness if the photo is to be used for anything for profit.

So... wants to shoot with me? haha

This thread is way to long to read but the copy rights are owned by the person who created the art work. When you hire a photographer normally the copyrights are transferred to you. When models do work for TF which means either for model or portfolio building with no fee usage rights of the photos and restrictions are controlled by the photographer. Here is a sample contract, http://www.pbjae.us/TFP%20Contract.pdf

So if the photographer had a watermark requirement and it is removed then the photographer can file a DMCA take down request and sue if it is not complied with.

Sorry if somebody already mentioned this.

EDIT. Just saw that this was already explained much better a few posts above.
I don't do contracts. The ladies don't want their real names out there and neither do I. So we go on a hand shake and trust. I'm an escort and photographer, so I totally understand the need for privacy.

The ladies trust that I will not do anything to their photos unless asked permission. If she retires and wants her photos taken down from my site, I take them down immediately... Also, the lady has the option of a watermark or not. I give them both if asked...

Thanks for the promotion ya'll!

I love my job(s)

Happy New Year!

I'll be starting a national thread before long about BIG ASS BANNERS across pictutres and "Copy Rights". I hope photographers like your self get a lot of new business once that threAD gets started.

Bcdstudios, there is nothing offensive at all about your watermark or placement. This gent just likes to ruffle feathers and cause stinks where none exist.

I agree that he shouldn't have touched your photo, period. As someone who knows a little about graphic design, changing the size and placement or even removing it all together is quite simple if you have the originals. You do fine work, so don't let his criticisms get to you. Xo Originally Posted by Tracy Auburn

Sure, this isn't for profit and is just for fun, but making such a rule is creating an unnecessary obstacle to getting the best final product. BCD is offering the photos, highly skilled and professional work, for free and only asks that his unobtrusive label be on it. It's ungrateful to complain about it. Originally Posted by Petruchio

And to who are you showing them? How about the ladies who don't want their faces revealed? Are you making sure that you retain rights to show their facial images unblurred with your artistic rights?

In my opinion you have shown the ladies of this community exactly who they should be staying away from. Most are repulsed by the thought of having someone else pimping them out. I see no difference if their images are being pimped out by a photo pimp!

Don't think for one moment I'm done with you and your lies and BS.

You talk your 'industry" bull shit but never address the simple issues brought forward by me. You talk out of both sides of your mouth and contradict yourself. Love the Global warming comment LOL You made a big deal out of someone trying to do something nice. As I stated before, I have the same PM'S and emails. All providers were to submit photos without photographer’s names on them. I explained this to you yet you insisted yours be put back on. It's as simple as that so the pictures were removed.

Then you act as if you have some secret BS via PM or email. You do NOT! You littered my thread with your nonsense in Kansas as well as this one. Trust me whatever little talent you might have is overshadowed by how you do business.

And YES your water mark is OFFENSIVE. A discreet "BCD" placed on pictures would... how did you put it?.... Give you credit. But nooooooo..... you need to display your awesomeness by being ..

BCDSTUDIOS(Use loud thunderous voice!)

Yes BCD studios...able to leap tall couches in a single bound (With or without his pants we're still not sure!). Able to turn on lights on with the flip of a switch. And who disguised as a petty little wantabe takes hot chicks and plasters gigantic banners across their pictures, fights a never ending battle to get credit for every insignificant thing he does.

If you decide to use any thing I post as a marketing tool by all means go ahead. I won’t need any credit. But please remember…Vagina Triangle®, Hooker Whisper® and Slamdango® are registered trademarks. Hell SLAMDANGO is even in the urban dictionary. Check for yourself.
